Types of appeal

This section explains the different types of appeals that can be lodged with the Minister for Environment under the Environmental Protection Act 1986. Please select from the following subject areas for details on specific rights of appeal, the time to make the appeal, and the format of the appeal process:

  • Environmental impact assessment
    For appeals against decisions of the Environmental Protection Authority in relation to assessment of development proposals and planning schemes
  • Licensing and works approval
    For appeals against decisions of the Department of Environment and Conservation in relation to licensing and approval of prescribed premises
  • Clearing native vegetation
    For appeals against decisions of the Department of Environment and Conservation in relation to clearing native vegetation
  • Compliance notices
    For appeals against environmental protection notices, closure notices, vegetation conservation notices and prevention notices
  • Vehicle emission notices
    For appeals against the conditions of a vehicle emmission notice

Appeals under legislation dealing with water entitlements are now determined by the State Administrative Tribunal.
